1 Acceptance of Terms

By accessing or using the Viva Appliances website at vivaappliances.com (the "Site") or by placing an order with us, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Site or services.

These Terms apply to all visitors, users, and customers of the Site. Viva Appliances reserves the right to update these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

These Terms constitute the entire agreement between you and Viva Appliances (4701 NW 79th Ave, Suite 06, Doral, FL 33166, USA) regarding your use of the Site.

2 Eligibility

You must be at least 18 years of age and a legal resident of the United States to purchase from Viva Appliances. By placing an order, you confirm that you meet these requirements. We reserve the right to refuse service to anyone at our sole discretion.

3 Products & Inventory

All products listed on vivaappliances.com are genuine US-model appliances sourced and inspected at our Doral, Florida facility. We make every effort to ensure product descriptions, images, and specifications are accurate. However:

• Product images are for illustrative purposes. Actual appearance may vary slightly.
• Manufacturer specifications are subject to change without notice. Always verify specs on the manufacturer's website before purchase.
• We reserve the right to limit quantities available for purchase.
• We reserve the right to discontinue any product at any time.

4 Pricing & Payments

All prices on vivaappliances.com are listed in US Dollars (USD) and are inclusive of any applicable product taxes shown at checkout. Prices are subject to change without notice and may differ from prices in third-party marketplaces.

• We reserve the right to correct pricing errors at any time. If your order is affected by a pricing error, we will notify you and offer a cancellation or the corrected price.
• Sales tax is applied based on applicable Florida and destination state laws.
• Payment is accepted via PayPal, which supports credit cards, debit cards, and PayPal balances.
• Payment is processed at the time of order placement. You will receive an order confirmation email upon successful payment.
• All transactions are encrypted and secured via SSL. We do not store your payment card details on our servers.

5 Order Processing & Cancellations

Submitting an order constitutes an offer to purchase. Your order is confirmed when you receive a written order confirmation email from us. We reserve the right to refuse or cancel any order at our discretion, including in cases of pricing errors, suspected fraud, or product unavailability.

• Orders may be cancelled for a full refund if cancelled before the item has shipped from our facility.
• To cancel, contact us at (786) 550-6769 or info@vivaappliances.com as soon as possible with your order number.
• Once an order has shipped, it cannot be cancelled and must be processed as a return per our Returns & Refunds Policy.

6 Shipping & Delivery

Shipping terms, delivery timeframes, curbside delivery procedures, and damage claim procedures are governed by our Shipping & Delivery Policy, which is incorporated into these Terms by reference.

We ship to addresses within the United States only. We do not ship to international addresses.

7 Returns & Refunds

Our Returns & Refunds Policy governs all return, refund, and exchange requests and is incorporated into these Terms by reference. Key points:

• Returns must be initiated within 30 calendar days of delivery.
• Items must be unused, uninstalled, and in original packaging.
• A 15% restocking fee applies to standard returns.
• Return shipping is the customer's responsibility for change-of-mind returns.

8 Warranty

All appliances sold by Viva Appliances come with the original manufacturer's warranty applicable to US-model products. Viva Appliances does not provide any additional warranty beyond the manufacturer's warranty, unless stated otherwise in writing at the time of sale.

• Warranty claims must be made directly to the manufacturer or through our customer service team who can assist in facilitating the process.
• Manufacturer warranties do not cover damage caused by improper installation, misuse, power surges, or unauthorized modifications.

9 Limitation of Liability

To the fullest extent permitted by applicable law, Viva Appliances shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Use or inability to use our products or services
• Delays in delivery caused by freight carriers or circumstances beyond our control
• Errors or omissions in product descriptions or specifications
• Unauthorized access to or alteration of your data

Our total liability to you for any claim arising out of or relating to these Terms or your use of our services shall not exceed the amount you paid for the specific order giving rise to the claim.

This limitation does not apply to claims arising from gross negligence, willful misconduct, or fraud by Viva Appliances.

10 Disclaimer of Warranties

Our Site and its content are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses. We reserve the right to correct any errors or omissions on the Site at any time.

11 Intellectual Property

All content on vivaappliances.com — including but not limited to text, graphics, logos, images, product descriptions, and website design — is the property of Viva Appliances or its content suppliers and is protected by applicable US intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on our Site without prior written permission from Viva Appliances. You may view and print pages for personal, non-commercial use only.

12 Prohibited Uses

You agree not to use the Site or our services to:

• Engage in fraudulent, deceptive, or unlawful activities
• Submit false or misleading information in any order or communication
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools (bots, scrapers) to extract data from our Site without written permission
• Resell products purchased from us in violation of any applicable laws or our separate reseller terms (if any)
• Harass, threaten, or harm our staff, other customers, or any third party

13 Governing Law & Dispute Resolution
